Therefore, when, in accordance with the regulations, the customer has the status of consumer, the sales operations will be understood to have been carried out at the customer&#8217;s domicile; otherwise, the Owner&#8217;s jurisdiction will apply. <\/span><\/p><p><span style=\"font-weight: 400;\">The languages of operation of the website and in which the contract can be formalized are Spanish and English. In the event of a discrepancy between the Spanish and English versions of these Terms and Conditions, the Spanish version shall prevail. The Owner reserves the right to expand the languages. <\/span><\/p><p><span style=\"font-weight: 400;\">Acceptance of these General Terms and Conditions implies the express acceptance of these Terms and Conditions by the user. They will be understood to be completed at the time the user completes the contracting procedure, it being understood that the monitoring of all the phases of the electronic contracting procedure and the inclusion of all the requested data suppose, together with the satisfactory payment, where appropriate, a direct manifestation of the user&#8217;s willingness to accept these Terms and Conditions of contract. <\/span><\/p><p><span style=\"font-weight: 400;\">Contracts entered into electronically will produce all the effects provided for by the legal system, when consent and the other requirements necessary for their validity are met. In any case, the electronic medium in which these general conditions are recorded, and the contract entered into electronically will be admissible as documentary evidence in the event of a dispute between the parties. <\/span><\/p><p><span style=\"font-weight: 400;\">The Owner reserves the right to make any modifications to the website at any time and without prior notice, which it deems appropriate, and may update products and services according to market needs. Users are recommended to periodically review the website and these Terms and Conditions to be promptly informed and updated of the news regarding Miss Flamingo&#8217;s products and services, as well as its General Terms and Conditions of contract. <\/span><\/p><p><b>2.1 Platform operation<\/b><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo is a digital platform accessible through its website that allows users to discover, personalise and book original leisure, tourism, gastronomy and wellness experiences offered by third-party providers.<\/span><\/p><p><span style=\"font-weight: 400;\">Users can browse through the different proposals available, consult their description, conditions, prices and availability, as well as add complementary services (themed setting, extras for celebrations, transport, etc.) and manage the booking and payment securely directly from the platform.<\/span><\/p><p><span style=\"font-weight: 400;\">Once the reservation is made, Miss Flamingo sends the confirmation to the user and notifies the supplier for the preparation and execution of the experience.<\/span><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo acts as a technological and commercial intermediary, facilitating contact between users and suppliers, managing the booking process, collection and, where appropriate, mediation in the event of incidents. However, the effective provision of the service is the sole responsibility of the provider. <\/span><\/p><ol start=\"3\"><li><b> Types of users<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">a) End users (customers): Individuals over 18 years of age, tourists or residents, who use the platform to discover, book or personalise experiences.<\/span><\/p><p><span style=\"font-weight: 400;\">b) Experience providers: Natural or legal persons (self-employed, companies or local entities) that offer their services through the platform: tourist guides, chefs, wineries, photographers, artisans, wellness centres, etc.<\/span><\/p><p><b>4. Registration and validation<\/b><\/p><p><b>4.1 Registration of customers (end users)<\/b><\/p><p><span style=\"font-weight: 400;\">To access the full functionalities of the Miss Flamingo platform, users must pre-register using one of the following methods:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Account creation with email address and password.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Google Account authentication.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">During the registration process, the user must expressly accept these Terms and Conditions and the Privacy Policy. You can also set up your personal profile, save favourite experiences, and receive personalized communications. <\/span><\/p><p><span style=\"font-weight: 400;\">The user guarantees that all information provided during registration is true, accurate, up-to-date and complete. In case of detecting incorrect or fraudulent data, Miss Flamingo reserves the right to suspend or delete the account. <\/span><\/p><p><span style=\"font-weight: 400;\">Account Security<\/span><\/p><p><span style=\"font-weight: 400;\">The user is solely responsible for maintaining the confidentiality of his\/her login credentials and for all activities carried out under his\/her account. In the event of unauthorised use or suspected unauthorised access, you must immediately notify Customer Service. <\/span><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo will not be liable for any loss or damage arising from the user&#8217;s failure to comply with this obligation.<\/span><\/p><p><span style=\"font-weight: 400;\">To the extent permitted by applicable law, the user assumes responsibility for all activities carried out from his\/her account or using his\/her password and must immediately inform the Owner in the event that he\/she believes that his\/her password is being used in an unauthorized manner.<\/span><\/p><p><span style=\"font-weight: 400;\">The user may change his\/her password when he\/she deems it appropriate, for example, because he\/she suspects or verifies that the confidentiality of the password has occurred.<\/span><\/p><p><span style=\"font-weight: 400;\">Likewise, the user undertakes to keep their data duly updated. <\/span><\/p><p><b>4.2 Supplier registration and validation<\/b><\/p><p><span style=\"font-weight: 400;\">The incorporation of experience providers to the platform is subject to a manual validation process by the Miss Flamingo team, with the aim of guaranteeing the quality, safety and legality of the activities offered.<\/span><\/p><p><span style=\"font-weight: 400;\">Requirements to be a supplier:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Initial registration by means of a registration form or application.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Submission of mandatory documentation that may include:<\/span><ul><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">DNI\/NIE\/CIF or valid identification document.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Detailed description of the activity or experience offered.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Licences or administrative authorisations, if applicable.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Valid civil liability insurance certificate.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Proof of being registered as a self-employed person, company or entity.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Bank information for payment of the amounts generated.<\/span><\/li><\/ul><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Signing of a specific collaboration agreement with STAR MARKETING SOLUTIONS, S.L., detailing the conditions of use, commissions and obligations of both parties.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Once validated, the supplier will gain access to a management panel where they can:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Publish new experiences with images, descriptions, conditions and prices.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Set up availability and manage bookings.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">View statistics, user ratings, and pending payments.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Obligations of the validated supplier:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Keep the information published on your profile and in each experience updated.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ensure that it has the legal, technical and material capacity to correctly provide the contracted services.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Act in accordance with the principles of good faith, professionalism and respect for users.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Miss Flamingo reserves the right to suspend or delete the supplier profile in the event of non-compliance with legal, regulatory or contractual requirements, as well as repeated complaints or inappropriate practices.<\/span><\/p><ol start=\"5\"><li><b> Contracting process<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">The hiring process at Miss Flamingo is as follows:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Choice of experience or thematic package: Users will be able to choose from various options from those available on the website.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Add optional add-on services (setting, transportation, gifts, celebrations&#8230;): Users will be able to add additional services to the selected experiences or packages, to personalize or expand them.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Automatic calculation of the final price: Once the selection of the experience has been made, and where appropriate, of the optional services, the platform will automatically calculate the price.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Payment: Users will be able to choose the different means of payment available on the platform, all of them through secure gateways:<\/span><\/li><\/ol><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">Virtual POS: allows payment by debit or credit card (Visa, Mastercard) and Bizum.<\/span><\/li><li><span style=\"font-weight: 400;\">Stripe: Allows payment by debit or credit card (including Mastercard and American Express), as well as Apple Pay, Google Pay, and PayPal<\/span><span style=\"font-weight: 400;\">. <\/span><\/li><\/ul><\/li><\/ul><p><span style=\"font-weight: 400;\">The user must pay the full price at the time of booking.<\/span><\/p><p><span style=\"font-weight: 400;\"> 5. Confirmation of the contract: Once the payment has been made, the client will immediately receive an email with the confirmation of the reservation and the main information of the contracted experience. The booking confirmation and invoice will be available for consultation and download in the user&#8217;s profile, within the corresponding section of the platform. Depending on the type of experience, validation may be delayed. <\/span><\/p><ol start=\"6\"><li><b> Cancellation and refund policy<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">In accordance with the provisions of article 103.a) of Royal Legislative Decree 1\/2007, of 16 November, which approves the Revised Text of the General Law for the Defence of Consumers and Users and other complementary laws, users are informed that, once the booking has been confirmed, with the prior express consent of the client, the intermediation service provided by Miss Flamingo will have begun its execution, so it will not be subject to the right of withdrawal.<\/span><\/p><p><span style=\"font-weight: 400;\">Cancellation conditions may vary depending on the type of experience contracted. In any case, users may consult the specific cancellation conditions applicable to each experience on the website in advance. <\/span><\/p><p><span style=\"font-weight: 400;\">Some experiences allow free cancellation with a minimum period of 24 hours, 48 hours or up to 7 days before the scheduled date. Others, such as those that include tickets, personalized services, or non-refundable products, may not allow cancellation or refund. <\/span><\/p><p><span style=\"font-weight: 400;\">Cancellation must be managed exclusively through the Bookings section of the user profile on the Miss Flamingo platform.<\/span><\/p><p><span style=\"font-weight: 400;\">In case of doubts or incidents during the process, users can contact the support team using the form available on the &#8220;Support&#8221; page of the platform.<\/span><\/p><p><span style=\"font-weight: 400;\">Cancellations made after the established period may entail penalties or the impossibility of making any refund.<\/span><\/p><p><span style=\"font-weight: 400;\">In cases where a full or partial refund is required, the refund will be made using the same payment method used for the booking.<\/span><\/p><p><span style=\"font-weight: 400;\">In the event of a refund, Miss Flamingo will refund the payment method using the same payment method used in the booking, deducting only the payment processing fees applied by the payment provider. The fees applied by the payment provider in the original transaction are not refundable by the payment provider and will therefore be deducted from the amount to be returned to the customer. Indicative example: for a booking of \u20ac50, with an approximate commission of 1.5% + \u20ac0.25, the commission would be \u20ac1 and the refund would be \u20ac49. For any questions or discrepancies regarding the amount refunded, the user may contact Customer Service at <a href=\"mailto:esther@missflamingo.es\">esther@missflamingo.es<\/a>. <\/span><\/p><p><span style=\"font-weight: 400;\">In the event that the experience provider cancels the experience or it cannot take place due to force majeure, the customer will be offered the possibility of choosing between receiving a full refund or a change of dates.<\/span><\/p><p><span style=\"font-weight: 400;\">In the event that any optional complementary service added to the experience cannot be provided for reasons beyond the user&#8217;s control, Miss Flamingo will manage the partial refund corresponding to the value of the extra not enjoyed, when applicable.<\/span><\/p><p><span style=\"font-weight: 400;\">The specific conditions of each experience will be available at all times before formalizing the reservation.<\/span><\/p><ol start=\"7\"><li><b> Particular conditions of the suppliers<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Each provider establishes its conditions of execution, cancellation, physical or material requirements, minimum number of participants, languages, among others. The user accepts these conditions when formalizing the reservation. <\/span><\/p><ol start=\"8\"><li><b> Brokerage services<\/b><\/li><\/ol><p><b>8.1 Nature of the activity<\/b><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo is a technological platform owned by STAR MARKETING SOLUTIONS, S.L. whose purpose is to put users interested in living tourist, cultural, gastronomic, sports or wellness experiences in contact with independent providers that offer them.<\/span><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo does not directly organize, execute or market the experiences, but acts as a facilitating intermediary in the contracting between the parties. Consequently, Miss Flamingo is not a party to the contract for the provision of services entered into between the user and the provider, except in those cases in which it is expressly indicated otherwise. <\/span><\/p><p><b>8.2 Provision of the service by third parties<\/b><\/p><p><span style=\"font-weight: 400;\">The services or experiences contracted through the platform are provided by independent providers, who are solely responsible for:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The quality, adequacy, legality, compliance and execution of the service.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Obtaining the necessary authorizations, licenses and insurance.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Customer service during the performance of the activity.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Compliance with applicable local regulations on tourism, safety, consumption, protection of minors, accessibility, etc.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Miss Flamingo is limited to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Publish the offers, prices and conditions established by suppliers.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Manage the booking and collection process through the platform.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make a management panel for their services available to suppliers.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transfer the corresponding amount (deducting the agreed commission) once the activity has been carried out.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To act as a neutral mediator in the event of incidents or complaints.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The supplier will be responsible for issuing the corresponding invoice to the end customer for the service provided, applying the corresponding VAT according to their activity.
