Therefore, where the customer qualifies as a consumer under applicable law, transactions shall be deemed to take place at the customer\u2019s place of residence; otherwise, the jurisdiction of the Owner shall apply. <\/span><\/p><p><span style=\"font-weight: 400;\">The website operates in Spanish and English, and the contract may be entered into in either language. In the event of any discrepancy between the Spanish and English versions of these Terms and conditions, the Spanish version shall prevail. The Owner reserves the right to add additional languages.   <\/span><\/p><p><span style=\"font-weight: 400;\">Acceptance of these General terms and conditions constitutes the user\u2019s express agreement to be bound by them. The contract shall be deemed concluded when the user completes the booking process. Completion of all stages of the electronic booking process and provision of all requested information, together with successful payment where applicable, shall constitute a direct expression of the user\u2019s intention to accept these Terms and conditions of booking. <\/span><\/p><p><span style=\"font-weight: 400;\">Contracts entered into electronically shall have all the legal effects provided for under applicable law, provided that consent and all other requirements necessary for their validity are met. In any event, the electronic medium containing these General terms and conditions and the contract entered into electronically shall be admissible as documentary evidence in the event of a dispute between the parties. <\/span><\/p><p><span style=\"font-weight: 400;\">The Owner reserves the right to make any changes to the website that it considers appropriate, at any time and without prior notice, and may update products and services in accordance with market needs. Users are advised to review the website and these Terms and conditions periodically to keep informed and up to date with any changes relating to Miss Flamingo\u2019s products and services, as well as its General terms and conditions of booking. <\/span><\/p><p><b>2.1 How the platform works<\/b><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo is a digital platform accessible through its website that allows users to discover, personalise and book unique leisure, tourism, gastronomy and wellness experiences offered by third-party providers.<\/span><\/p><p><span style=\"font-weight: 400;\">Users can browse the different experiences available, view their descriptions, terms, prices and availability, add optional services (themed decoration, celebration extras, transport, etc.), and securely manage their booking and payment directly through the platform.<\/span><\/p><p><span style=\"font-weight: 400;\">Once the booking has been made, Miss Flamingo sends a confirmation to the user and notifies the provider so that the experience can be prepared and delivered.<\/span><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo acts as a technological and commercial intermediary, facilitating contact between users and providers and managing the booking and payment process, as well as, where applicable, mediating in the event of any issues. However, the actual provision of the service is the sole responsibility of the provider. <\/span><\/p><ol start=\"3\"><li><b> Types of users<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">a) End users (customers): Individuals aged 18 or over, whether tourists or residents, who use the platform to discover, book or personalise experiences.<\/span><\/p><p><span style=\"font-weight: 400;\">b) Experience providers: Individuals or legal entities (self-employed professionals, companies or local organisations) that offer their services through the platform, such as tour guides, chefs, wineries, photographers, artisans, wellness centres, etc.<\/span><\/p><p><b>Registration and verification<\/b><\/p><p><b>4.1 Customer registration (end users)<\/b><\/p><p><span style=\"font-weight: 400;\">To access the full features of the Miss Flamingo platform, users must first register using one of the following methods:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Creating an account using an email address and password.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Authentication using a Google account.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">During the registration process, the user must expressly accept these Terms and conditions and the Privacy policy. Users may also set up their personal profile, save favourite experiences and receive personalised communications. <\/span><\/p><p><span style=\"font-weight: 400;\">The user guarantees that all information provided during registration is truthful, accurate, up to date and complete. If incorrect or fraudulent information is detected, Miss Flamingo reserves the right to suspend or delete the account. <\/span><\/p><p><span style=\"font-weight: 400;\">Account security<\/span><\/p><p><span style=\"font-weight: 400;\">The user is solely responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account. In the event of unauthorised use or suspected unauthorised access, the user must immediately notify Customer service. <\/span><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo shall not be liable for any loss or damage arising from the user\u2019s failure to comply with this obligation.<\/span><\/p><p><span style=\"font-weight: 400;\">To the extent permitted by applicable law, the user shall be responsible, as appropriate, for all activities carried out through their account or using their password and must immediately notify the Owner if they believe that their password is being used without authorisation.<\/span><\/p><p><span style=\"font-weight: 400;\">The user may change their password whenever they consider it appropriate, for example, if they suspect or become aware that the confidentiality of their password has been compromised.<\/span><\/p><p><span style=\"font-weight: 400;\">The user also agrees to keep their information up to date. <\/span><\/p><p><b>4.2 Provider registration and verification<\/b><\/p><p><span style=\"font-weight: 400;\">The onboarding of experience providers to the platform is subject to a manual verification process by the Miss Flamingo team, with the aim of ensuring the quality, safety and legality of the activities offered.<\/span><\/p><p><span style=\"font-weight: 400;\">Requirements for becoming a provider:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Initial registration via the registration form or provider application.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Submission of required documentation, which may include:<\/span><ul><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">DNI\/NIE\/CIF or other valid identification document.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Detailed description of the activity or experience offered.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Administrative licences or authorisations, where applicable.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Valid civil liability insurance certificate.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Proof of registration as a self-employed professional, company or other legal entity.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Bank details for payment of the amounts generated.<\/span><\/li><\/ul><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Signing of a specific collaboration agreement with STAR MARKETING SOLUTIONS, S.L., setting out the terms of use, commissions and obligations of both parties.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">Once verified, the provider will have access to a management dashboard where they can:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Publish new experiences with images, descriptions, terms and prices.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Set availability and manage bookings.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">View statistics, user reviews and pending payments.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Obligations of verified providers:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Keep the information published on their profile and for each experience up to date.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ensure that they have the legal, technical and operational capacity to properly provide the booked services.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Act in accordance with the principles of good faith, professionalism and respect towards users.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Miss Flamingo reserves the right to suspend or remove a provider\u2019s profile in the event of non-compliance with legal, regulatory or contractual requirements, as well as in cases of repeated complaints or inappropriate practices.<\/span><\/p><ol start=\"5\"><li><b> Booking process<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">The booking process on Miss Flamingo is as follows:<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Selection of an experience or themed package: Users may choose from the various options available on the website.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Adding optional additional services (themed decoration, transport, gifts, celebrations, etc.): Users may add additional services to the selected experiences or packages in order to personalise or enhance them.<br\/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Automatic calculation of the final price: Once the experience and, where applicable, any optional additional services have been selected, the platform will automatically calculate the final price.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Payment: Users may choose from the different payment methods available on the platform, all processed through secure payment gateways:<\/span><\/li><\/ol><ul><li style=\"list-style-type: none;\"><ul><li><span style=\"font-weight: 400;\">Virtual POS terminal: allows payment by debit or credit card (Visa, Mastercard) and Bizum.<\/span><\/li><li>Stripe: allows payment by debit or credit card (including Mastercard and American Express), as well as Apple Pay, Google Pay and PayPal.  <\/li><\/ul><\/li><\/ul><p><span style=\"font-weight: 400;\">The user must pay the full price at the time of booking.<\/span><\/p><p><span style=\"font-weight: 400;\">  5. Booking confirmation: Once payment has been completed, the customer will immediately receive an email confirming the booking and containing the main details of the experience booked. The booking confirmation and invoice will also be available to view and download from the user\u2019s profile in the relevant section of the platform. Depending on the type of experience, confirmation may be subject to a delay.  <\/span><\/p><ol start=\"6\"><li><b> Cancellation and refund policy<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">In accordance with Article 103(a) of Royal Legislative Decree 1\/2007 of 16 November, approving the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws, users are informed that, once the booking has been confirmed, and with the customer\u2019s prior express consent, the intermediary service provided by Miss Flamingo will have begun to be performed and will therefore not be subject to the right of withdrawal.<\/span><\/p><p><span style=\"font-weight: 400;\">Cancellation conditions may vary depending on the type of experience booked. In all cases, users will be able to review the specific cancellation conditions applicable to each experience on the website before booking. <\/span><\/p><p><span style=\"font-weight: 400;\">Some experiences allow free cancellation with a minimum notice period of 24 hours, 48 hours or up to 7 days before the scheduled date. Others, such as those including tickets, personalised services or non-refundable products, may not allow cancellation or refunds. <\/span><\/p><p><span style=\"font-weight: 400;\">Cancellations must be managed exclusively through the Bookings section of the user\u2019s profile on the Miss Flamingo platform.<\/span><\/p><p><span style=\"font-weight: 400;\">If users have any questions or experience any issues during the process, they may contact the support team using the form available on the platform\u2019s \u201cSupport\u201d page.<\/span><\/p><p><span style=\"font-weight: 400;\">Cancellations made outside the specified cancellation period may be subject to penalties or may not be eligible for any refund.<\/span><\/p><p><span style=\"font-weight: 400;\">Where a full or partial refund is applicable, it will be issued using the same payment method used for the booking.<\/span><\/p><p><span style=\"font-weight: 400;\">In the event of a refund, Miss Flamingo will issue the refund using the same payment method used for the booking, deducting only the payment processing fees charged by the payment provider. The fees charged by the payment provider for the original transaction are non-refundable by that provider and will therefore be deducted from the amount refunded to the customer. As an illustrative example, for a \u20ac50 booking with an approximate fee of 1.5% + \u20ac0.25, the processing fee would be \u20ac1 and the refund would be \u20ac49. For any questions or discrepancies regarding the refunded amount, the user may contact Customer service at <a href=\"mailto:esther@missflamingo.es\">esther@missflamingo.es<\/a>.   <\/span><\/p><p><span style=\"font-weight: 400;\">If the experience provider cancels the experience or if it cannot take place due to force majeure, the customer will be offered the choice between a full refund or rescheduling the experience.<\/span><\/p><p><span style=\"font-weight: 400;\">If any optional additional service added to the experience cannot be provided for reasons beyond the user\u2019s control, Miss Flamingo will arrange, where applicable, a partial refund corresponding to the value of the additional service not received.<\/span><\/p><p><span style=\"font-weight: 400;\">The specific terms and conditions of each experience will be available at all times before the booking is completed.<\/span><\/p><ol start=\"7\"><li><b> Specific terms and conditions of providers<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Each provider establishes its own terms regarding the delivery of the experience, cancellation, physical or equipment requirements, minimum number of participants, languages, among other conditions. The user accepts these terms when completing the booking. <\/span><\/p><ol start=\"8\"><li><b> Intermediary services<\/b><\/li><\/ol><p><b>8.1 Nature of the activity<\/b><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo is a technology platform owned by STAR MARKETING SOLUTIONS, S.L. whose purpose is to connect users interested in tourism, cultural, gastronomic, sports or wellness experiences with independent providers offering such experiences.<\/span><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo does not directly organise, provide or sell the experiences, but acts as an intermediary facilitating bookings between the parties. Accordingly, Miss Flamingo is not a party to the service agreement entered into between the user and the provider, except where expressly stated otherwise. <\/span><\/p><p><b>8.2 Provision of services by third parties<\/b><\/p><p><span style=\"font-weight: 400;\">The services or experiences booked through the platform are provided by independent providers, who are solely responsible for:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The quality, suitability, legality, compliance and delivery of the service.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Obtaining the necessary authorisations, licences and insurance.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Providing customer service during the activity.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Compliance with applicable local regulations regarding tourism, safety, consumer protection, protection of minors, accessibility, etc.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Miss Flamingo\u2019s role is limited to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Publishing the offers, prices and terms established by the providers.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Managing the booking and payment process through the platform.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Providing providers with a management dashboard for their services.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transferring the corresponding amount (after deducting the agreed commission) once the activity has been completed.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Acting as a neutral intermediary in the event of any issues or complaints.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">The provider shall be responsible for issuing the corresponding invoice to the end customer for the service provided, applying the applicable VAT rate according to their activity. Miss Flamingo shall invoice the provider exclusively for the intermediary commission in accordance with the collaboration agreement signed between the parties.  <\/span><\/p><p><b>8.3 Limitation of liability<\/b><\/p><p><span style=\"font-weight: 400;\">Miss Flamingo shall not be liable for any damage, loss, contractual or non-contractual breaches, accidents, delays or cancellations arising from:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The provider\u2019s conduct or actions.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Errors or omissions in the information provided by the provider.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Modifications, substitutions or cancellations of the service without prior notice or outside the scope of the platform.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Force majeure or unforeseen circumstances affecting the experience.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Miss Flamingo shall also not be liable for the loss of personal belongings, injuries or any other incidents that may occur during the experience.
