These General terms and conditions regulate access to and use of the Miss Flamingo website, as well as the terms under which users (customers) contract experiences managed by external providers. Miss Flamingo acts as an intermediary, facilitating contracting between users and experience providers.
In the event that any or all of these Conditions become null and void or unenforceable for legal or material reasons, the others will not be affected, which will apply insofar as they are not affected.

The contracting system is subject to the legislation in force in Spain. Therefore, when, in accordance with the regulations, the customer has the status of consumer, the sales operations will be understood to have been carried out at the customer’s domicile; otherwise, the Owner’s jurisdiction will apply.
The languages of operation of the website and in which the contract can be formalized are Spanish and English. In the event of a discrepancy between the Spanish and English versions of these Terms and Conditions, the Spanish version shall prevail. The Owner reserves the right to expand the languages.
Acceptance of these General Terms and Conditions implies the express acceptance of these Terms and Conditions by the user. They will be understood to be completed at the time the user completes the contracting procedure, it being understood that the monitoring of all the phases of the electronic contracting procedure and the inclusion of all the requested data suppose, together with the satisfactory payment, where appropriate, a direct manifestation of the user’s willingness to accept these Terms and Conditions of contract.
Contracts entered into electronically will produce all the effects provided for by the legal system, when consent and the other requirements necessary for their validity are met. In any case, the electronic medium in which these general conditions are recorded, and the contract entered into electronically will be admissible as documentary evidence in the event of a dispute between the parties.
The Owner reserves the right to make any modifications to the website at any time and without prior notice, which it deems appropriate, and may update products and services according to market needs. Users are recommended to periodically review the website and these Terms and Conditions to be promptly informed and updated of the news regarding Miss Flamingo’s products and services, as well as its General Terms and Conditions of contract.
2.1 Platform operation
Miss Flamingo is a digital platform accessible through its website that allows users to discover, personalise and book original leisure, tourism, gastronomy and wellness experiences offered by third-party providers.
Users can browse through the different proposals available, consult their description, conditions, prices and availability, as well as add complementary services (themed setting, extras for celebrations, transport, etc.) and manage the booking and payment securely directly from the platform.
Once the reservation is made, Miss Flamingo sends the confirmation to the user and notifies the supplier for the preparation and execution of the experience.
Miss Flamingo acts as a technological and commercial intermediary, facilitating contact between users and suppliers, managing the booking process, collection and, where appropriate, mediation in the event of incidents. However, the effective provision of the service is the sole responsibility of the provider.
a) End users (customers): Individuals over 18 years of age, tourists or residents, who use the platform to discover, book or personalise experiences.
b) Experience providers: Natural or legal persons (self-employed, companies or local entities) that offer their services through the platform: tourist guides, chefs, wineries, photographers, artisans, wellness centres, etc.
4. Registration and validation
4.1 Registration of customers (end users)
To access the full functionalities of the Miss Flamingo platform, users must pre-register using one of the following methods:
During the registration process, the user must expressly accept these Terms and Conditions and the Privacy Policy. You can also set up your personal profile, save favourite experiences, and receive personalized communications.
The user guarantees that all information provided during registration is true, accurate, up-to-date and complete. In case of detecting incorrect or fraudulent data, Miss Flamingo reserves the right to suspend or delete the account.
Account Security
The user is solely responsible for maintaining the confidentiality of his/her login credentials and for all activities carried out under his/her account. In the event of unauthorised use or suspected unauthorised access, you must immediately notify Customer Service.
Miss Flamingo will not be liable for any loss or damage arising from the user’s failure to comply with this obligation.
To the extent permitted by applicable law, the user assumes responsibility for all activities carried out from his/her account or using his/her password and must immediately inform the Owner in the event that he/she believes that his/her password is being used in an unauthorized manner.
The user may change his/her password when he/she deems it appropriate, for example, because he/she suspects or verifies that the confidentiality of the password has occurred.
Likewise, the user undertakes to keep their data duly updated.
4.2 Supplier registration and validation
The incorporation of experience providers to the platform is subject to a manual validation process by the Miss Flamingo team, with the aim of guaranteeing the quality, safety and legality of the activities offered.

Miss Flamingo reserves the right to suspend or delete the supplier profile in the event of non-compliance with legal, regulatory or contractual requirements, as well as repeated complaints or inappropriate practices.
The hiring process at Miss Flamingo is as follows:
The user must pay the full price at the time of booking.
5. Confirmation of the contract: Once the payment has been made, the client will immediately receive an email with the confirmation of the reservation and the main information of the contracted experience. The booking confirmation and invoice will be available for consultation and download in the user’s profile, within the corresponding section of the platform. Depending on the type of experience, validation may be delayed.
In accordance with the provisions of article 103.a) of Royal Legislative Decree 1/2007, of 16 November, which approves the Revised Text of the General Law for the Defence of Consumers and Users and other complementary laws, users are informed that, once the booking has been confirmed, with the prior express consent of the client, the intermediation service provided by Miss Flamingo will have begun its execution, so it will not be subject to the right of withdrawal.
Cancellation conditions may vary depending on the type of experience contracted. In any case, users may consult the specific cancellation conditions applicable to each experience on the website in advance.
Some experiences allow free cancellation with a minimum period of 24 hours, 48 hours or up to 7 days before the scheduled date. Others, such as those that include tickets, personalized services, or non-refundable products, may not allow cancellation or refund.
Cancellation must be managed exclusively through the Bookings section of the user profile on the Miss Flamingo platform.
In case of doubts or incidents during the process, users can contact the support team using the form available on the “Support” page of the platform.
Cancellations made after the established period may entail penalties or the impossibility of making any refund.
In cases where a full or partial refund is required, the refund will be made using the same payment method used for the booking.
In the event of a refund, Miss Flamingo will refund the payment method using the same payment method used in the booking, deducting only the payment processing fees applied by the payment provider. The fees applied by the payment provider in the original transaction are not refundable by the payment provider and will therefore be deducted from the amount to be returned to the customer. Indicative example: for a booking of €50, with an approximate commission of 1.5% + €0.25, the commission would be €1 and the refund would be €49. For any questions or discrepancies regarding the amount refunded, the user may contact Customer Service at esther@missflamingo.es.
In the event that the experience provider cancels the experience or it cannot take place due to force majeure, the customer will be offered the possibility of choosing between receiving a full refund or a change of dates.
In the event that any optional complementary service added to the experience cannot be provided for reasons beyond the user’s control, Miss Flamingo will manage the partial refund corresponding to the value of the extra not enjoyed, when applicable.
The specific conditions of each experience will be available at all times before formalizing the reservation.
Each provider establishes its conditions of execution, cancellation, physical or material requirements, minimum number of participants, languages, among others. The user accepts these conditions when formalizing the reservation.
8.1 Nature of the activity
Miss Flamingo is a technological platform owned by STAR MARKETING SOLUTIONS, S.L. whose purpose is to put users interested in living tourist, cultural, gastronomic, sports or wellness experiences in contact with independent providers that offer them.
Miss Flamingo does not directly organize, execute or market the experiences, but acts as a facilitating intermediary in the contracting between the parties. Consequently, Miss Flamingo is not a party to the contract for the provision of services entered into between the user and the provider, except in those cases in which it is expressly indicated otherwise.
8.2 Provision of the service by third parties
The services or experiences contracted through the platform are provided by independent providers, who are solely responsible for:

The supplier will be responsible for issuing the corresponding invoice to the end customer for the service provided, applying the corresponding VAT according to their activity. Miss Flamingo will invoice the supplier exclusively for the commission for intermediation in accordance with the collaboration agreement signed between the parties.
8.3 Exclusion of liability
Miss Flamingo shall not be liable for any damages, losses, breaches of contract or tort, accidents, delays or cancellations arising from:
Miss Flamingo will not be responsible for the loss of personal belongings, injuries or any incident that may occur during the experience, being in any case the supplier who must have the relevant insurance.
8.4 Supervision and quality control
Without prejudice to the foregoing, Miss Flamingo:

The legal relationship between Miss Flamingo and the suppliers is regulated by a specific collaboration agreement, which establishes the conditions of use of the platform, the commission system, the legal and contractual obligations of the parties, and the protocols for resolving incidents.
This agreement does not imply an employment, corporate, agency or franchise relationship between Miss Flamingo and the supplier, but a collaboration between independent parties, where each one acts at their own risk and responsibility.
8.6 Non-circumvention of the platform
The suppliers undertake not to promote, offer or directly or indirectly contract the experiences with users they have met through the Miss Flamingo platform outside of said platform, in order to avoid paying the corresponding commissions.
Likewise, users undertake not to contact suppliers directly with the aim of making reservations outside the platform when they have learned about the service through Miss Flamingo.
Miss Flamingo reserves the right to suspend or cancel accounts of users or suppliers who fail to comply with this obligation.
By contracting the services of Miss Flamingo, users, in addition to the obligations arising from their status as customers, voluntarily assume the following obligations:
The experiences offered are aimed at people over 18 years of age. In the case of the participation of minors, the authorization and supervision of a responsible adult will be necessary, and compliance with the specific requirements established for each experience.
To resolve doubts, incidents or act as a mediator between supplier and customer or obtain information about its products and services, Miss Flamingo offers a Customer Service Department.

The support team undertakes to respond within a maximum period of 48 working hours from the receipt of the query, except for force majeure.

12.2 Purpose of processing
The data of registered users who contract any of our products will be processed for the correct provision of our services. To do this, it will be necessary for your information to be communicated to the different suppliers of Miss Flamingo whose information is detailed in each of the products offered.
Similarly, the data of registered users will be processed for the purpose of sending personalised commercial information, by telephone, postal and/or electronic, which may be of interest about the company’s products, services, promotional offers, etc. and information related to the tourism sector. If the user wishes to receive such commercial communications, they can indicate this by checking the corresponding box provided for this purpose on the respective channels.
Likewise, the user authorises STAR MARKETING SOLUTIONS, S.L. to send notifications related to the management of bookings or the status of the contracted services, through email, messages within the platform or push notifications, provided that such communications are directly linked to the provision of the service and are not of a commercial nature.
The completion of all the data requested through the different forms is necessary to achieve an optimal provision of the services made available to the user. If not all data is provided, there is no guarantee that the information and services provided can be provided correctly or meet your needs.

As Miss Flamingo acts as an intermediary entity, the data of the users who contract the services of Miss Flamingo will be communicated to the different providers related to the services provided. This communication of data is necessary for the correct provision of the contracted services.
In addition, STAR MARKETING SOLUTIONS, S.L. has the collaboration of third-party service providers who have access to your personal data and who process the aforementioned data in the name and on behalf of STAR MARKETING SOLUTIONS, S.L. as a result of its provision of services. Specifically, STAR MARKETING SOLUTIONS, S.L. will contract the provision of services by third-party providers that carry out their activity, including but not limited to, in the following sectors: computer maintenance and technological services companies, transport companies, and advertising agencies.

In the case of tools such as Google Analytics or Meta Ads, international data transfers may take place to third countries such as the United States. In these cases, providers have adopted standard contractual clauses approved by the European Commission to ensure an adequate level of protection of personal data.

12.9 How long will we keep user data?
The data of users and suppliers will be kept for the entire period of validity of the contractual relationship.
Once the contractual relationship has ended, the data will be kept duly blocked for the legally established periods, exclusively for the fulfilment of legal obligations or for the exercise or defence of possible claims.
The personal data provided by users for promotional purposes will be kept until the user revokes their consent, without prejudice to their right of deletion or opposition. In this case, they will also be kept blocked for the time necessary to attend to possible liabilities arising from the processing.
12.10 Security measures
STAR MARKETING SOLUTIONS, S.L. will establish the technical and organisational measures necessary to guarantee the security that must be met by the automated processing of the data of the interested parties, the processing centres, premises, equipment, systems, programmes and people involved in the automated processing of personal data in the manner provided for by law and regulations.
12.11 Right to lodge a complaint with the supervisory authorities
Data subjects have the possibility of contacting the Spanish Data Protection Agency about any questions in the exercise of their rights, to resolve any incident in the processing of their data or to file a complaint. The Spanish Data Protection Agency has the function of ensuring compliance with the legislation and controlling its application. 12.12 Use of Images
The photographs and/or videos in which Customers appear during the provision of the services may be used by MISS FLAMINGO, S.L. exclusively for promotional, advertising and marketing purposes of the platform and the experiences offered, provided that the Customer has given their express consent by marking the checkbox enabled for this purpose in the booking process. or, where appropriate, by any other means valid in law.
Under no circumstances will these images be used without the prior express and documented consent of the Client.
In the event that the images appear under 14 years of age, it will be an essential requirement to obtain the prior, express and written consent of their parents, guardians or legal representatives, who will be fully responsible for authorising such processing.
The Client may revoke the consent granted at any time, without retroactive effects, by means of a request addressed to the contact address indicated in these Terms and Conditions, and MISS FLAMINGO, S.L. will cease the use of the images on digital media, although the material may be kept on media that have already been published or disseminated until the date of revocation.
Miss Flamingo does not guarantee the continuity of the platform or the absence of errors. It is not responsible for technical problems, system crashes or external circumstances that affect the operation of the website.
Miss Flamingo reserves the right to modify these conditions at any time. The current conditions will always be accessible from the website and applicable at the time of contracting.
These Terms and Conditions are governed by Spanish law.
Any conflicts that may arise from the interpretation of these rules will be resolved by the corresponding Courts in accordance with the law in force and depending on the consumer’s domicile.
Users are also informed that the European Online Dispute Resolution (ODR) Platform will cease to be operational as of 20 July 2025, in accordance with Regulation (EU) 2024/3228. Until July 19, 2025, users will be able to access the platform to consult information or export their personal data, but they will not be able to file new complaints.

Once the ODR platform is no longer available, users who wish to resolve disputes related to services contracted through Miss Flamingo will be able to resort to the Alternative Dispute Resolution (ADR) mechanisms available in Spain.
