Purpose of the processing

At STAR MARKETING SOLUTIONS, S.L. (hereinafter “Miss Flamingo”), we process your personal data for the purpose of managing your registration on our website, enabling you to access information about and purchase our products and services.

We also process the personal data of registered users to send personalised commercial communications by telephone, post and/or electronic means about our experiences, services, promotional offers and other information that may be of interest, as well as news and updates related to the tourism sector. If you wish to receive these marketing communications, you can indicate your consent by selecting the corresponding checkbox provided for this purpose on the relevant forms or channels.

The personal data of registered users who book experiences through the platform will be processed for the purpose of providing our services. To deliver the booked experience, it will be necessary to share the relevant information with the corresponding Miss Flamingo provider, whose details are available on each experience page.

Use of images and audiovisual content: Where customers expressly authorise this by selecting the checkbox provided during the booking process, Miss Flamingo may use photographs and/or videos taken during the experience for promotional, advertising and marketing purposes, for example on its website, social media channels or in corporate materials. Such processing will never take place without the customer’s prior and verifiable consent. In the case of children under the age of 14, prior written authorisation from their parents or legal guardians will be required. Data subjects may withdraw their consent at any time or request the removal of the content in accordance with the provisions set out in the “User rights” section.

With regard to providers, their personal data will be processed for the purpose of managing their commercial relationship with Miss Flamingo in connection with the services they provide.

Providing all the information requested through the various forms is necessary to enable us to provide our services effectively. If you do not provide all the required information, we cannot guarantee that our services will be provided correctly or that they will meet your needs.

Categories of personal data

The categories of personal data we may process include:

Identification data: first name, surname, email address, telephone number, image and/or voice.
Personal characteristics: date of birth and sex.
Financial data: where you book our services, we may process payment information, including credit or debit card details.

We may also process technical data, such as your IP address, unique device identifiers, browser type, operating system, and information about your use of the website collected through cookies or other tracking technologies. For more information, please refer to our Cookie policy.

We do not process special categories of personal data, such as data relating to health, political opinions, trade union membership, religion or philosophical beliefs, unless such processing is strictly necessary and you have given your explicit consent.

In the case of providers, we process the information necessary to manage the relevant contractual relationship. This includes identification data, such as first name, surname, postal address and national identity card (DNI) details, as well as financial and commercial information.

The personal data we process is provided directly by users through the various forms available on the website, and by providers through their service agreements with Miss Flamingo.

Legal basis for processing

The legal basis for processing your personal data for the purpose of sending marketing communications is your consent. Likewise, the use of customers’ images for promotional and marketing purposes is based on their explicit consent. In the case of children under the age of 14, such consent must be given by their parents or legal guardians. Consent is obtained freely, specifically, on an informed basis and through a clear affirmative action by the user, in accordance with Article 6(1)(a) of the General Data Protection Regulation (GDPR).

Where users book any of our services, the legal basis for processing their personal data is the performance of the contract they enter into.

Likewise, the legal basis for processing providers’ personal data is the performance of the relevant contract and the legitimate interests of the parties.

All the information we request is mandatory. Failure to provide any of the required information may prevent us from providing our services.

Who do we share your personal data with?

As Miss Flamingo acts as an intermediary platform, the personal data of users who book experiences through our platform will be shared with the relevant providers responsible for delivering those experiences. This sharing of personal data is necessary to provide the services you have booked.

Where photographs or videos are taken during an experience and the customer has given their explicit consent, this content may be published through Miss Flamingo’s communication and marketing channels, including its website, social media, advertising campaigns and promotional materials. This may involve sharing personal data with the platforms and service providers that host such content, such as Instagram, Facebook and YouTube.

In addition, STAR MARKETING SOLUTIONS, S.L. works with third-party service providers that may access and process your personal data on its behalf in connection with the services they provide. These providers may include, without limitation, IT maintenance and technology service companies, transport companies and advertising agencies.

International data transfers

When using tools such as Google Analytics or Meta Ads, your personal data may be transferred to third countries, including the United States. In such cases, the relevant providers have implemented the European Commission’s Standard Contractual Clauses (SCCs) to ensure an adequate level of protection for your personal data.

User rights

You may exercise the following rights at any time, free of charge:

Right of access: You have the right to obtain confirmation as to whether we process your personal data and, where that is the case, to access that personal data.
Right to rectification: You have the right to request the correction of inaccurate personal data and to have incomplete personal data completed.
Right to erasure: You have the right to request the erasure of your personal data without undue delay, for example, where the data is no longer necessary for the purposes for which it was collected or where you have withdrawn your consent.
Right to restriction of processing: You have the right to request that we restrict the processing of your personal data in certain circumstances. In such cases, we will only retain your personal data for the establishment, exercise or defence of legal claims, or as otherwise permitted by applicable law.
Right to data portability: You have the right to receive your personal data in a structured, commonly used and machine-readable format. You also have the right to request that your personal data be transmitted directly to another data controller, where technically feasible.

How long do we keep your personal data?

We will retain the personal data of users and providers for the duration of the contractual relationship.

Once the contractual relationship has ended, your personal data will be securely retained in a restricted form for the periods required by applicable law, solely for the purpose of complying with legal obligations or for the establishment, exercise or defence of legal claims.

Personal data provided for promotional purposes will be retained until you withdraw your consent. This includes photographs and/or videos used for promotional purposes, without prejudice to your right to erasure or to object to the processing. Where consent is withdrawn, such personal data will be securely retained in a restricted form only for the period necessary to comply with legal obligations or for the establishment, exercise or defence of legal claims.

Security measures

STAR MARKETING SOLUTIONS, S.L. will implement the appropriate technical and organisational measures to ensure the security of the automated processing of personal data, including the processing facilities, premises, equipment, systems, software and personnel involved, in accordance with applicable legal and regulatory requirements.

Right to lodge a complaint with a supervisory authority

You also have the right to contact the Spanish Data Protection Agency (Agencia Española de Protección de Datos – AEPD) if you have any questions about exercising your rights, if you believe your personal data has been processed unlawfully, or if you wish to lodge a complaint. The AEPD is the supervisory authority responsible for ensuring compliance with data protection legislation in Spain. In particular, you have the right to lodge a complaint with the AEPD if you consider that your rights have not been respected or you have not obtained satisfaction in the exercise of those rights.
