These General terms and conditions of booking govern access to and use of the Miss Flamingo website, as well as the terms under which users (customers) book experiences managed by third-party providers. Miss Flamingo acts as an intermediary, facilitating bookings between users and experience providers.
If any provision of these Terms and conditions becomes null, void or unenforceable for legal or practical reasons, the remaining provisions shall remain unaffected and shall continue to apply insofar as they are not affected.

The booking system is governed by the legislation in force in Spain. Therefore, where the customer qualifies as a consumer under applicable law, transactions shall be deemed to take place at the customer’s place of residence; otherwise, the jurisdiction of the Owner shall apply.
The website operates in Spanish and English, and the contract may be entered into in either language. In the event of any discrepancy between the Spanish and English versions of these Terms and conditions, the Spanish version shall prevail. The Owner reserves the right to add additional languages.
Acceptance of these General terms and conditions constitutes the user’s express agreement to be bound by them. The contract shall be deemed concluded when the user completes the booking process. Completion of all stages of the electronic booking process and provision of all requested information, together with successful payment where applicable, shall constitute a direct expression of the user’s intention to accept these Terms and conditions of booking.
Contracts entered into electronically shall have all the legal effects provided for under applicable law, provided that consent and all other requirements necessary for their validity are met. In any event, the electronic medium containing these General terms and conditions and the contract entered into electronically shall be admissible as documentary evidence in the event of a dispute between the parties.
The Owner reserves the right to make any changes to the website that it considers appropriate, at any time and without prior notice, and may update products and services in accordance with market needs. Users are advised to review the website and these Terms and conditions periodically to keep informed and up to date with any changes relating to Miss Flamingo’s products and services, as well as its General terms and conditions of booking.
2.1 How the platform works
Miss Flamingo is a digital platform accessible through its website that allows users to discover, personalise and book unique leisure, tourism, gastronomy and wellness experiences offered by third-party providers.
Users can browse the different experiences available, view their descriptions, terms, prices and availability, add optional services (themed decoration, celebration extras, transport, etc.), and securely manage their booking and payment directly through the platform.
Once the booking has been made, Miss Flamingo sends a confirmation to the user and notifies the provider so that the experience can be prepared and delivered.
Miss Flamingo acts as a technological and commercial intermediary, facilitating contact between users and providers and managing the booking and payment process, as well as, where applicable, mediating in the event of any issues. However, the actual provision of the service is the sole responsibility of the provider.
a) End users (customers): Individuals aged 18 or over, whether tourists or residents, who use the platform to discover, book or personalise experiences.
b) Experience providers: Individuals or legal entities (self-employed professionals, companies or local organisations) that offer their services through the platform, such as tour guides, chefs, wineries, photographers, artisans, wellness centres, etc.
Registration and verification
4.1 Customer registration (end users)
To access the full features of the Miss Flamingo platform, users must first register using one of the following methods:
During the registration process, the user must expressly accept these Terms and conditions and the Privacy policy. Users may also set up their personal profile, save favourite experiences and receive personalised communications.
The user guarantees that all information provided during registration is truthful, accurate, up to date and complete. If incorrect or fraudulent information is detected, Miss Flamingo reserves the right to suspend or delete the account.
Account security
The user is solely responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account. In the event of unauthorised use or suspected unauthorised access, the user must immediately notify Customer service.
Miss Flamingo shall not be liable for any loss or damage arising from the user’s failure to comply with this obligation.
To the extent permitted by applicable law, the user shall be responsible, as appropriate, for all activities carried out through their account or using their password and must immediately notify the Owner if they believe that their password is being used without authorisation.
The user may change their password whenever they consider it appropriate, for example, if they suspect or become aware that the confidentiality of their password has been compromised.
The user also agrees to keep their information up to date.
4.2 Provider registration and verification
The onboarding of experience providers to the platform is subject to a manual verification process by the Miss Flamingo team, with the aim of ensuring the quality, safety and legality of the activities offered.

Miss Flamingo reserves the right to suspend or remove a provider’s profile in the event of non-compliance with legal, regulatory or contractual requirements, as well as in cases of repeated complaints or inappropriate practices.
The booking process on Miss Flamingo is as follows:
The user must pay the full price at the time of booking.
5. Booking confirmation: Once payment has been completed, the customer will immediately receive an email confirming the booking and containing the main details of the experience booked. The booking confirmation and invoice will also be available to view and download from the user’s profile in the relevant section of the platform. Depending on the type of experience, confirmation may be subject to a delay.
In accordance with Article 103(a) of Royal Legislative Decree 1/2007 of 16 November, approving the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws, users are informed that, once the booking has been confirmed, and with the customer’s prior express consent, the intermediary service provided by Miss Flamingo will have begun to be performed and will therefore not be subject to the right of withdrawal.
Cancellation conditions may vary depending on the type of experience booked. In all cases, users will be able to review the specific cancellation conditions applicable to each experience on the website before booking.
Some experiences allow free cancellation with a minimum notice period of 24 hours, 48 hours or up to 7 days before the scheduled date. Others, such as those including tickets, personalised services or non-refundable products, may not allow cancellation or refunds.
Cancellations must be managed exclusively through the Bookings section of the user’s profile on the Miss Flamingo platform.
If users have any questions or experience any issues during the process, they may contact the support team using the form available on the platform’s “Support” page.
Cancellations made outside the specified cancellation period may be subject to penalties or may not be eligible for any refund.
Where a full or partial refund is applicable, it will be issued using the same payment method used for the booking.
In the event of a refund, Miss Flamingo will issue the refund using the same payment method used for the booking, deducting only the payment processing fees charged by the payment provider. The fees charged by the payment provider for the original transaction are non-refundable by that provider and will therefore be deducted from the amount refunded to the customer. As an illustrative example, for a €50 booking with an approximate fee of 1.5% + €0.25, the processing fee would be €1 and the refund would be €49. For any questions or discrepancies regarding the refunded amount, the user may contact Customer service at esther@missflamingo.es.
If the experience provider cancels the experience or if it cannot take place due to force majeure, the customer will be offered the choice between a full refund or rescheduling the experience.
If any optional additional service added to the experience cannot be provided for reasons beyond the user’s control, Miss Flamingo will arrange, where applicable, a partial refund corresponding to the value of the additional service not received.
The specific terms and conditions of each experience will be available at all times before the booking is completed.
Each provider establishes its own terms regarding the delivery of the experience, cancellation, physical or equipment requirements, minimum number of participants, languages, among other conditions. The user accepts these terms when completing the booking.
8.1 Nature of the activity
Miss Flamingo is a technology platform owned by STAR MARKETING SOLUTIONS, S.L. whose purpose is to connect users interested in tourism, cultural, gastronomic, sports or wellness experiences with independent providers offering such experiences.
Miss Flamingo does not directly organise, provide or sell the experiences, but acts as an intermediary facilitating bookings between the parties. Accordingly, Miss Flamingo is not a party to the service agreement entered into between the user and the provider, except where expressly stated otherwise.
8.2 Provision of services by third parties
The services or experiences booked through the platform are provided by independent providers, who are solely responsible for:

The provider shall be responsible for issuing the corresponding invoice to the end customer for the service provided, applying the applicable VAT rate according to their activity. Miss Flamingo shall invoice the provider exclusively for the intermediary commission in accordance with the collaboration agreement signed between the parties.
8.3 Limitation of liability
Miss Flamingo shall not be liable for any damage, loss, contractual or non-contractual breaches, accidents, delays or cancellations arising from:
Miss Flamingo shall also not be liable for the loss of personal belongings, injuries or any other incidents that may occur during the experience. In all cases, the provider shall be responsible for maintaining the appropriate insurance coverage.
8.4 Supervision and quality control
Without prejudice to the foregoing, Miss Flamingo:

The legal relationship between Miss Flamingo and its providers is governed by a specific collaboration agreement, which sets out the terms of use of the platform, the commission structure, the legal and contractual obligations of the parties, and the procedures for resolving issues.
This agreement does not create an employment, partnership, agency or franchise relationship between Miss Flamingo and the provider, but rather a collaboration between independent parties, each acting at its own risk and under its own responsibility.
8.6 Non-circumvention of the platform
Providers agree not to promote, offer or arrange, directly or indirectly, bookings outside the Miss Flamingo platform with users they have connected with through the platform for the purpose of avoiding the applicable commissions.
Likewise, users agree not to contact providers directly for the purpose of making bookings outside the platform when they have discovered the service through Miss Flamingo.
Miss Flamingo reserves the right to suspend or terminate the accounts of users or providers who fail to comply with this obligation.
By booking services through Miss Flamingo, users, in addition to the obligations arising from their status as customers, voluntarily assume the following obligations:
The experiences offered are intended for persons aged 18 or over. Where minors participate, the authorisation and supervision of a responsible adult will be required, as well as compliance with the specific requirements established for each experience.
To answer questions, resolve issues, act as an intermediary between providers and customers, or provide information about its products and services, Miss Flamingo offers a Customer service.

Customer service hours are Monday to Friday, from 9:00 am to 7:00 pm (Spanish mainland time), excluding public holidays.
The support team undertakes to respond within a maximum of 48 business hours from receipt of the enquiry, except in cases of force majeure.

12.2 Purpose of data processing
The personal data of registered users who book any of our products will be processed for the proper provision of our services. For this purpose, it will be necessary to share their information with the relevant Miss Flamingo providers, whose details are specified for each product offered.
We also process the personal data of registered users to send personalised commercial communications by telephone, post and/or electronic means about our experiences, services, promotional offers and other information that may be of interest, as well as news and updates related to the tourism sector. If you wish to receive these marketing communications, you can indicate your consent by selecting the corresponding checkbox provided for this purpose on the relevant forms or channels.
The user also authorises STAR MARKETING SOLUTIONS, S.L. to send notifications relating to booking management or the status of booked services by email, in-platform messages or push notifications, provided that such communications are directly related to the provision of the service and are not commercial in nature.
Providing all the information requested through the various forms is necessary to enable us to provide our services effectively. If you do not provide all the required information, we cannot guarantee that our services will be provided correctly or that they will meet your needs.

The legal basis for processing customers’ personal data is the performance of the contract to which they are a party.
The legal basis for processing users’ personal data for the purpose of sending commercial communications is their consent. Consent shall be obtained freely, specifically, informedly and unambiguously through a clear affirmative action by the user, in accordance with Article 6(1)(a) of the General Data Protection Regulation (GDPR).

As Miss Flamingo acts as an intermediary platform, the personal data of users who book experiences through our platform will be shared with the relevant providers responsible for delivering those experiences. This sharing of personal data is necessary to provide the services you have booked.
In addition, STAR MARKETING SOLUTIONS, S.L. works with third-party service providers that may access and process your personal data on its behalf in connection with the services they provide. These providers may include, without limitation, IT maintenance and technology service companies, transport companies and advertising agencies.
12.7 International data transfers
When using tools such as Google Analytics or Meta Ads, your personal data may be transferred to third countries, including the United States. In such cases, the relevant providers have implemented the European Commission’s Standard Contractual Clauses (SCCs) to ensure an adequate level of protection for your personal data.

12.9 How long will we retain users’ personal data?
We will retain the personal data of users and providers for the duration of the contractual relationship.
Once the contractual relationship has ended, your personal data will be securely retained in a restricted form for the periods required by applicable law, solely for the purpose of complying with legal obligations or for the establishment, exercise or defence of legal claims.
Personal data provided by users for promotional purposes will be retained until the user withdraws their consent, without prejudice to their right to erasure or to object to the processing. In such cases, the data will also be retained in a restricted form for the period necessary to address any potential liabilities arising from the processing.
12.10 Security measures
STAR MARKETING SOLUTIONS, S.L. will implement the appropriate technical and organisational measures to ensure the security of the automated processing of personal data, including the processing facilities, premises, equipment, systems, software and personnel involved, in accordance with applicable legal and regulatory requirements.
12.11 Right to lodge a complaint with a supervisory authority
Data subjects may contact the Spanish Data Protection Agency (AEPD) with any questions regarding the exercise of their rights, to resolve any issues concerning the processing of their personal data, or to lodge a complaint. The Spanish Data Protection Agency is responsible for ensuring compliance with data protection legislation and monitoring its application. Data subjects may lodge a complaint with the AEPD, particularly where they have not obtained a satisfactory response regarding the exercise of their rights, at Calle de Jorge Juan, 6, 28001 Madrid, through the AEPD website, or by telephone on 900 293 183.
12.12 Use of images
Photographs and/or videos featuring Customers during the provision of services may be used by MISS FLAMINGO, S.L. exclusively for promotional, advertising and marketing purposes relating to the platform and the experiences offered, provided that the Customer has given their express consent by ticking the checkbox provided for this purpose during the booking process or, where applicable, by any other legally valid means.
Under no circumstances will such images be used without the Customer’s prior express and documented consent.
If the images feature children under the age of 14, the prior, express and written consent of their parents, guardians or legal representatives shall be required. Such persons shall be fully responsible for authorising the processing of the images.
The Customer may withdraw their consent at any time, without retroactive effect, by submitting a request to the contact address specified in these Terms and conditions. MISS FLAMINGO, S.L. will cease using the images on digital media, although material already produced or distributed before the date of withdrawal may remain in circulation.
Miss Flamingo does not guarantee the uninterrupted availability of the platform or that it will be free from errors. It shall not be liable for technical issues, system outages or circumstances beyond its control that affect the operation of the website.
Miss Flamingo reserves the right to modify these Terms and conditions at any time. The terms currently in force will always be available on the website and those applicable at the time of booking shall apply.
These Terms and conditions are governed by Spanish law.
Any disputes arising from the interpretation of these Terms and conditions shall be resolved by the courts having jurisdiction under applicable law, taking into account the consumer’s place of residence.
Users are also informed that the European Online Dispute Resolution (ODR) Platform ceased to operate on 20 July 2025, in accordance with Regulation (EU) 2024/3228. Until 19 July 2025, users were able to access the platform to consult information or export their personal data, but could no longer submit new complaints.
For more information about the platform and to export their data before the deadline, users may visit the ODR website.
Once the ODR platform is no longer available, users wishing to resolve disputes relating to services booked through Miss Flamingo may use the Alternative Dispute Resolution (ADR) mechanisms available in Spain.
