Purpose of processing

At STAR MARKETING SOLUTIONS, S.L. (hereinafter Miss Flamingo) we process the users personal data in order to manage the registration on our website, so that they can access the information and contract our offers and services.

Similarly, the data of registered users will be processed for the purpose of sending personalised commercial information, by telephone, postal and/or electronic, which may be of interest about the company’s products, services, promotional offers, etc. and information related to the tourism sector. If the user wishes to receive such commercial communications, they can indicate this by checking the corresponding box provided for this purpose on the respective channels.

Registered users who contract experiences through the platform will be processed for the correct provision of our services. To do this, it will be necessary for your information to be communicated to the different suppliers of Miss Flamingo whose information is detailed in each of the products offered.

Use of images and audiovisual content: In the event that customers expressly authorise it through the checkbox enabled during the booking process, Miss Flamingo may use the images and/or videos captured during the experience for promotional, advertising and marketing purposes (for example, on its website, social networks or corporate materials). Under no circumstances will this processing be carried out without prior and verifiable consent. For minors under 14 years of age, the prior written authorization of their parents or legal guardians will be required. Data subjects may revoke their consent at any time or request the removal of the content in accordance with the provisions of the “User Rights” section.

In relation to suppliers, your data will be processed to maintain the commercial relationship with Miss Flamingo in relation to the services provided by this company.

The completion of all the data requested through the different forms is necessary to achieve an optimal provision of the services made available to the user. If not all data is provided, there is no guarantee that the information and services provided can be provided correctly or meet your needs.

Data categories

The personal data that may be processed include:

Identification data: name, surname, email and telephone number, image and/or voice.
Data relating to personal characteristics: date of birth and sex.
Economic data: in the case of contracting services, data relating to means of payment such as credit or debit cards may be processed.

Under no circumstances will special categories of personal data, such as data relating to health, ideology, trade union membership, religion or beliefs, be processed, unless they are strictly necessary and the user has given their explicit consent.

In the case of suppliers, the information necessary to maintain the corresponding contractual relationship will be processed. In this case, identification data will be processed, such as name and surname, postal address, and identity document; as well as financial data and commercial activity.

The data are those provided by users through the different forms and by suppliers through service provision contracts.

Legitimacy

The legal basis for the processing of the user’s data will be consent for the purpose of sending commercial information. Similarly, the use of the image of the customers for promotional and marketing purposes will be carried out in accordance with the express consent of the customers. In the case of minors under 14 years of age, this consent must be granted by their parents or legal representatives. Consent will be obtained in a free, specific, informed and unequivocal manner, through a clear affirmative action by the user, in accordance with the provisions of article 6.1.a) of the General Data Protection Regulation (GDPR).

In cases where users contract any of our services, the legal basis for the processing of their data will be the execution of the contract to which they adhere.

Similarly, the legal basis in the case of the processing of supplier data will be based on the performance of the contract and the legitimate interest of the parties.

All the data we request from you is mandatory, so failure to comply with some of them may make it impossible to provide the services.

To whom will your data be communicated?

As Miss Flamingo acts as an intermediary entity, the data of the users who contract the services of Miss Flamingo will be communicated to the different providers related to the services provided. This communication of data is necessary for the correct provision of the contracted services.

In the case of images and videos obtained during the experiences, when the client has given their express consent, such images may be published on Miss Flamingo’s communication and marketing channels (website, social networks, advertising campaigns or promotional materials), and may involve the communication of data to the platforms and services that host such content (e.g., Instagram, Facebook, YouTube, etc.).

In addition, STAR MARKETING SOLUTIONS, S.L. has the collaboration of third-party service providers who have access to your personal data and who process the aforementioned data in the name and on behalf of STAR MARKETING SOLUTIONS, S.L. as a result of its provision of services. Specifically, STAR MARKETING SOLUTIONS, S.L. will contract the provision of services by third-party providers that carry out their activity, including but not limited to, in the following sectors: computer maintenance and technological services companies, transport companies, and advertising agencies.

International Data Transfers

In the case of tools such as Google Analytics or Meta Ads, international data transfers may take place to third countries such as the United States. Users’ rights

Users may at any time and free of charge exercise the following rights:

Right of access to the data subject’s personal data: the data subject can obtain confirmation as to whether the company processes personal data concerning them.
Right to rectification: the data subject has the right to request a rectification of inaccurate or incomplete data.
Right to erasure: the data subject may request the erasure of their data without undue delay, among other things, because they are no longer necessary, consent has been withdrawn, etc.
Right to limit the processing of data: the interested party may request that their personal data not be applied to the processing operations that would correspond in each case, in which case we will only keep them for the exercise or defence of claims.
Right to data portability. The interested party will be able to receive their data in a structured, commonly used and machine-readable format; likewise, the interested party may request that their data be transmitted to another Data Controller, provided that this is technically possible.
Right to object, the data subject opposes the processing and the company will stop processing their data, except for compelling legitimate reasons or the exercise or defence of possible claims.

How long will we keep user data?

The data of users and suppliers will be kept for the entire period of validity of the contractual relationship.

Once the contractual relationship has ended, the data will be kept duly blocked for the legally established periods, exclusively for the fulfilment of legal obligations or for the exercise or defence of possible claims.

The personal data provided by users for promotional purposes will be kept until the user revokes their consent, including the image obtained through promotional photographs and/or videos, without prejudice to their right of deletion or opposition. In this case, they will also be kept blocked for the time necessary to attend to possible liabilities arising from the processing.

Security measures

STAR MARKETING SOLUTIONS, S.L. will establish the technical and organisational measures necessary to guarantee the security that must be met by the automated processing of the data of the interested parties, the processing centres, premises, equipment, systems, programmes and people involved in the automated processing of personal data in the manner provided for by law and regulations.

Right to lodge a complaint with supervisory authorities

Likewise, interested parties have the possibility of contacting the Spanish Data Protection Agency about any doubt in the exercise of their rights, to resolve any incident in the processing of their data or to file a complaint.
